Conditions of purchase of products

1 AIM AND FIELD OF IMPLEMENTATION

The current General Conditions have as purpose to regulate the relationship between PYROISTECH S.L. (from now on PYROISTECH) and You (from now on the ) in all which concerns the transactions done in this website for the sale of the products that are available in the website www.pyroistech.com.

PYROISTECH is a Spanish company, with registered in Campus Arrosadía, Edificio Los Tejos, Pamplona 31006, Navarra.

Any incidence, complaint or claim about a purchase made through the website has to be addressed to the following email: info@pyroistech.com

 AGE OF MAJORITY, ACCEPTANCE AND PROOF OF ACCEPTANCE

This is an online shop of equipment for optical laboratories.

The purchase of our products has to be made by activating the button “Place order” that appears at the bottom of the page of the purchase order and implies the total acceptance of the current Purchase Conditions prior to the acquisition of our products, without application of the changes done in the clauses of the Purchase Conditions after the consignment of the acquired product.

PYROISTECH will send to the Client, once the current Purchase Conditions have been accepted, a justification of the by email less than 24 hours after the purchase has been made.

PYROISTECH informs you that we store all the electronic documents in which the purchase is formalized.

In case the Client made a mistake in the data that had been sent, the Client would be able to correct this data in the Customer Service Mailbox by writing to info@pyroistech.com

2 PAYMENT OPTIONS

The available payment options are the following:

  • Bank transfer:

If you choose the option “Bank transfer”, you will be provided with the account number to which you have to do the transfer. It is very important to place your name and surname on record, as well as including in the “Heading” of the Transfer the Order Number we have transmitted you in the email that confirms your order.

If the payment is done this way, we will have evidence in 1 or 2 working days. If it is urgent, we recommend you to send us a receipt of the Transfer by email to info@pyroistech.com.

  • Credit card:

We use a payment bridge in which the data are safely transmitted to the bank. You will have to fill in the necessary information by providing your credit card number, the expiry date and the security data. This way the system will accept your payment and the order will be processed. This data is directly managed by the banks. The transactions are done with the guarantee of the SSL protocol, which ensures the information is transmitted in a coded and protected way and to a safe server. You will immediately receive confirmation of your order, which will be given an Order Number.

In case the was not able to complete the transaction for any reason, it will be cancelled and the Client will be informed.

  • Paypal:

You must have a PayPal account. In case you do not have one, you can create it by using the link http://paypal.com. When you do the payment, you are redirected to the coded webpage (HTTPS – SSL) of PayPal, where you can do the payment with your user and password. Your credit card number or PayPal credentials will not be stored in our website.

3 ORDERS AND DELIVERY EXPENSES
3.1 Time and Place of Delivery

The maximum time of delivery is 15 days. If the time was greater by reasons unrelated to PYROISTECH, we will inform you about it in order to request an extension or partial/total cancellation of the order.

Since the order has left our stores, you will receive a locating code that will allow you, through the website of the corresponding carrier, to know the state of your consignment.

PYROISTECH considers the confirmation of the payment, using any of the payment options indicated, a necessary condition to maintain the time of delivery. Nevertheless, this time is an estimate and can vary due to logistical reasons or other unforeseen major problems. In case of delay, the Client will be informed at the appropriate time.

It is possible that the same order is divided in several deliveries. If that is the case, all the deliveries will be invoiced at once, that is, every order will be included in the same .

The delivery by the carrier will be done at the address that has been indicated as “Delivery Address”, so the Client has to provide a delivery address where a person is waiting for the reception of the order.

The Client has the right to cancel the purchase that has been done when, due to causes attributable to PYROISTECH, the delivery is delayed and there has not previously been any type of communication from PYROISTECH by phone, email or SMS. In order to do that, the Client has to follow the instructions that are described in the section “Return Policy”.  Supposing that the order is available for the Client within the agreed delivery date and the carrier is not able to deliver it due to a reason attributable to the Client, this situation will not be considered a delay.

With the locating code you will receive by email once your order has left our stores, you will be able to follow the consignment in the carrier’s , in order to know when its delivery will take place. Ten () working days after the departure of the consignment, if the delivery has not taken , it will be returned to PYROISTECH’s stores and the Client will have to take responsibility for the delivery and return expenses.

3.2 Reception of goods

When you receive the goods, you must check the packaging. If the packaging is damaged, it must be noted down on the receipt of the carrier agency “Damaged packaging. Awaiting review”.

As soon as possible, open the packaging with care to avoid any deterioration and allow a return, and if you find any damage, you will have to inform us by email to info@pyroistech.com in less than 24 hours after its reception.

This requisite is necessary to complain to the carrier agency for the damage the goods have suffered. If it is not done this way, the carrier agency will not admit the complaint and PYROISTECH won’t take any responsibility.

3.3 Cost of carriage

Spain (mainland territory)

The cost of carriage will be free for orders higher than 50 € (IVA included and after applying the discounts).

For orders lower than 50 €, 4,5€ will be invoiced for the cost of carriage.

Balearic Islands, Canary Islands, Ceuta and Melilla

The orders made from the Balearic Islands, the Canary Islands, Ceuta and/or Melilla will have a cost of carriage of 50 €.

Rest of Europe

The cost of carriage will be 50 €.

Rest of the world

The cost of carriage will be 100 €.

4 RETURN POLICY

All the returns have to be previously authorized and have to be requested by email to info@pyroistech.com, explaining the cause of the return.

The maximum deadline to request a return is seven (7) working days since the reception of the goods. After this deadline, returns will not be admitted. Once we have received your request, we will contact you to admit or reject the return and to inform you about the collection date and the address that has to be written down on a note stuck on the packaging.

The expenses caused by the consignment of the product (if there were) will not be refunded to the client. Similarly, the collection expenses of the product for its consignment to our offices will be responsibility of the client. These expenses are the cost of the consignment of the acquired type of product and to the destination of the consignment. Only PYROISTECH is authorized to request the withdrawal of the product by the carrier agency.

The returned product will only be accepted if it is has not been used or altered and if it is returned in its own packaging with its fitting out material, manuals, promotional presents and all the documents that were included. You will have to indicate very clearly the bill number and the reason of the return.

Once we have received the product, and after checking that it is in good condition, we will proceed to the refund of the cost using the same option that was chosen by the Client (payment with Credit Card, PayPal, Bank Transfer).

In every case, the return of defective products or incorrect consignments will be admitted, and in these cases PYROISTECH will be the one that will take responsibility for the delivery expenses whenever this circumstance is reported with a maximum delay of one (1) month (since the reception of the goods).

 

5 GUARANTEES
5.1 Guarantees

PYROISTECH, reports that the offered contractual guarantee is the one specified by the supplier or the manufacturer, in accordance with Real Decreto Legislativo 1/2007, of 16 November, that approves the revised text of Ley General para la Defensa de los Consumidores y Usuarios.

They are excluded from the guarantee:

  • The deficiencies caused by negligences, blows, not suitable tension, incorrect use or handling and/or bad installation.
  • Materials subjected to wear due to normal use.
  • Products modified or repaired by the client or any other person that has not been authorized by the manufacturer or the supplier.
  • Deterioration caused by external facts, accidents or non-observance of the conditions of use.
  • Breakdowns caused by components not provided by PYROISTECH.
  • In the cases that the general conditions of the manufacturer indicate it.

The guarantee is not applicable to the apparent vices and defects of accordance of the product, for which any complaint will have to be made by the Client in the next seven (7) days after the delivery of the product.

5.2 The guarantee loses its value:
  • If the data of the guarantee itself or the purchase receipt are modified, altered or replaced.
  • If the identification number or the guaranteed product itself are manipulated or repaired without informing the Technical Service or the company responsible for the guarantee.
  • If you lack the receipt or the purchase delivery note from PYROISTECH. In order to use the guarantee, it is necessary to file the guarantee certificate as well as the receipt or the purchase delivery note from PYROISTECH.

The Client can make the guarantee of a product come into effect according to the current regulations about the guarantee of consumer goods. In case of doubt, please do not hesitate to contact PYROISTECH.

5.3 Nullity

In case any of the present clauses is annulled, the other clauses will continue being in force and will be interpreted taking into account the will of the parties and the purpose of the General Purchase Conditions.

PYROISTECH, reserves the right to not exercise any of the rights and authorities conferred in the current purchase conditions. This authority does not imply in any case renouncing these rights, except if there is express recognition from PYROISTECH, or prescription of the action that corresponds in each case.

6 PERSONAL DATA AND COMMERCIAL COMMUNICATIONS

PYROISTECH will use the data provided by the Client according to the Privacy Policy that can be consulted in this webpage.

7 JURISDICTION AND APPLICABLE LAW

In case of conflict in the interpretation or the application of the current contractual conditions, as it is about final consumers, according to the applicable regulations, the Courts from the place of compliance of the obligation or the ones from the registered office of the purchasing party will be competent.

In case it is a buying and selling done by a company, both parties subject themselves, with express renunciation to any other privilege, to the Court of Navarra (Spain).

PYROISTECH, S.L, as responsible of the processing of the information you provide us, informs you that your data is asked for with the purpose of invoicing. The legal basis for this processing is the consent as interested party. Your data will not be transmitted to third parties except for legal obligation. The data provided will be stored while the commercial relationship is kept or the time is necessary to comply with the legal obligations and fulfil the possible responsibilities that could be derived from the compliance of the purpose that the data was asked for. We inform you that you have the right to access your data, rectify the inaccurate data, oppose the processing or portability of the data or request its suppression when the data is no longer necessary for the purpose it was asked for, writing us to the email address info@pyroistech.com. Similarly, you have the possibility of lodging a complaint in the Spanish Agency of Data Protection (AEPD), using its web www.aepd.es.
